Chapter 17: Equal Opportunity Programs

17.1 Delegation. All bureaus are delegated through their appropriate Assistant Secretary the following authority:

A. Operational Civil Rights Functions. Authority to process civil rights complaints, conduct complaint investigations and compliance reviews, and provide technical assistance and training in covered program areas under their jurisdiction. This delegation is being made under the authority of the following Federal anti-discrimination laws: (1) Title VI of the Civil Rights Act of 1964, [42 U.S.C. 2000d-2000d-4], (2) Section 504 of the Rehabilitation Act of 1973, as amended, [Pub. L. 93-112], (3) Title II of the Americans with Disabilities Act, [5 U.S.C. 301; 28 U.S.C. 509, 510; Title II, Pub. L. 101-336], (4) the Age Discrimination Act of 1975, and, (5) Title IX of the Education Amendments of 1972, [Pub. L. 92-318].

B. Federal Equal Employment Opportunity Functions. Authority to accept individual complaints of discrimination and investigate complaints under Title VII of the Rights Act of 1964, as amended, 29 U.S.C. 701-7; and the Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. 633a.

17.2 Director, Office for Equal Opportunity. The Director of the Departmental Office for Equal Opportunity (OEO) will provide oversight, policy direction, guidance, training and support in furtherance of this delegation. Responsibility for reporting to external oversight agencies, and, enforcement actions against recipients or respondents including, but not limited to, the termination of Federal assistance and referrals to the U.S. Department of Justice will rest with the Director of OEO.

17.3 Privacy Act. Bureaus covered by this delegation and maintaining records on individuals must have established safeguards for such records meeting the requirements of the Privacy Act of 1974, as amended, [5 U.S.C. 552A] and Departmental regulations at 43 CFR 2, Subpart D.

17.4 Limitations.

A. The Director of OEO's authority as provided in 210 DM 7.1 is not limited by this delegation.

B. The delegation in 17.1B above does not include authority for the acceptance and investigation of class action complaints.
