FAIR Act

The Federal Activities Inventory Reform Act of 1998 (Public Law 105-270), known as the FAIR Act, was enacted by Congress and requires executive agencies to make an annual accounting of government personnel, by location, function, and position, performing either commercial activities or inherently governmental activities and submit them to the Office of Management and Budget (OMB).  An activity function code is used to describe the work performed by each full time employee.

Competitive Sourcing

Competitive Sourcing is one of the five key elements of the President’s Management Agenda.  Under competitive sourcing, executive agencies must study some of the commercial activities performed by federal employees to determine if it is more efficient to procure such services from the private sector.

Section 647(b) of the Appropriations Act, (Public Law 108-199) establishes a government-wide reporting requirement for competitive sourcing.  Pursuant to the Section 647(b), each executive agency must annually inform Congress about its competitive sourcing efforts for the prior fiscal year.

Management Directive #0476, Performance of Commercial Activities (PDF, 26 pages – 103 KB) establishes Department of Homeland Security policies, procedures and responsibilities to implement (a) the Federal Activities Inventory Reform (FAIR) Act of 1998, (b) conduct public-private competitions in accordance with the OMB Circular A-76 and applicable Federal Acquisition Regulations, and c) serves as Departmental guidance regarding Competitive Sourcing and Privatization, including reimbursable agreements with another Federal Agency or public-private competitions.
