Copyright Arbitration Royalty Panels (CARP)

The CARP system consisted of ad hoc arbitration panels that recommended the royalty rates and distribution of royalty fees collected under certain of the statutory licenses and set some of the terms and conditions of some of the statutory licenses. Each CARP was selected for a particular proceeding (examples: a rate adjustment for the cable statutory license; a distribution of digital audio recording technology funds) and had up to 180 days to deliver its recommendation for the rate adjustment or distribution, as the case may be.

With the enactment of the Copyright Royalty and Distribution Reform Act of 2004 (P.L. 108-419) on Nov. 30, 2004, the Copyright Arbitration Royalty Panel (CARP) system that had been part of the Copyright Office since 1993 was phased out. The Act replaced CARP (which itself replaced the CRT in 1993) with a system of the Copyright Royalty Board (CRB), which determines rates and terms for the copyright statutory licenses and makes determinations on distribution of statutory license royalties collected by the Copyright Office. The CRJs are full-time employees in the Library who are appointed for six-year terms with an opportunity for reappointment. However, the first three judges serve two-, four- and six-year terms in order to establish a cycle that avoids replacing all three judges at the same time.
