Issue Physicians feel burdened by the requirement that verbal orders in the hospital must be signed by the individual physician giving the order.

This issue involves the Medicare Hospital Conditions of Participation. CMS' Office of Clinical Standards and Quality is actively reviewing this issue as well as others in the Conditions of Participation. Current guidance can be found in the CMS response to the AHA letter. The new Medicare CoP should be released in a few months.

Jul 7, 2004: Still waiting for internal clearance of the Hospital Conditions of Participation.

Aug 13, 2004: Due to the volume of regulations and the MMA, this process has been delayed but we still expect the Hospital Conditions of Participation to be released before 2005.

Dec 20, 2004: The PRIT will announce on this website when the Hospital CoP is released. It is in final approval and we are confident that it will be released soon.

March 25, 2005: CMS published a proposed rule — Hospital CoP 3122-P — that addresses this issue.
