Mission

The Office of Hearings is composed of administrative law judges, who hold hearings under the Administrative Procedure Act (5 U.S.C. § 551 et seq.) (“APA”) for the Department’s Office of the Secretary (primarily in aviation matters) and the Department’s component modal administrations that need formal APA hearings, including the Federal Aviation Administration (“FAA”), Federal Motor Carrier Safety Administration (“FMCSA”), Federal Railroad Administration (“FRA”), Maritime Administration (“MARAD”), National Highway Transportation Safety Administration (“NHTSA”), and the Pipeline and Hazardous Materials Safety Administration (“PHMSA”).
