1. Backlog reduction

a. Deficient Milestones

(1) OIG – One pending case that was scheduled to be closed out by 12/31/06 was still pending.

(2) FMCSA – One pending case that was scheduled to be closed out by 12/31/06 was still pending.

b. Steps Taken to Correct Deficiency

(1) OIG closed out its delinquent request on 5/24/07.

(2) FMCSA closed out its delinquent request on 3/15/07.

c. Additional Steps Needed – N/A

2. Electronic FOIA – electronic payment of FOIA fees

a. Deficient Milestone. Several interim milestones slipped although the Department was still on track for Department-wide June 2007 final completion.

b. Steps Taken to Correct Deficiency. Although there was slippage of some interim milestones, as of the end of June 2007 (the original deadline for overall completion of the goal), the FAA, FHWA, OST, FTA, and FMCSA completed all milestones necessary to accept electronic payments via “pay.gov.” These five departmental components that now can receive electronic payments account for 94 percent of fees collected (per the FY 2006 annual report). Five other components (OIG, FRA, NHTSA, MARAD, and PHMSA) had already been using “pay.gov” to accept electronic payments. Those initial five components accounted for 5.7 percent of FY 2006 payments received. The remaining two components (RITA and SLS) account for .3 percent of FY 2006 payments received. We are currently trying to determine the feasibility of setting up the two remaining components.

c. Additional Steps Needed. By 12/31/07, the Department will evaluate whether it is feasible, and if so, determine the appropriate timeframe, to add RITA and SLS to pay.gov.

c. Multi-track processing

a. Deficient Milestone. The Departmental FOIA Officer was scheduled to review multi-track processing practices of selected Federal agencies by 12/31/06. Competing demands in executive order implementation prevented the timely completion of this item.

b. Steps Taken to Correct Deficiency. The Departmental FOIA Officer reviewed the multi-track processing of selected agencies during June and July 2007.

c. Additional Steps Needed. N/A
