Riparian Rights and Takings

Matanzas Bay, St. Augustine, Fla. Harris Co. 1910. Library of Congress Panoramic Photograph Collection.

Module Description

Any discussion of Public Trust rights would be incomplete without recognizing private interests in the shore. This module describes the nature of riparian rights and their extent. As used in this module, the term “riparian rights” is meant to include littoral rights. Readers should note that in some states there are significant differences between the two.

Module Objectives

After completing this module, you will be able to

  • Define “riparian rights”
  • Explain the basis for riparian rights
  • Clearly state how far riparian rights extend
  • Describe the effect of harbor lines on riparian rights
  • List occasions when takings claims are likely to arise
  • Discuss how the Public Trust Doctrine serves as a defense against takings claims and provide examples
