Module Description

This module describes the methodologies for determining Public Trust waters and the boundaries for Public Trust and filled lands, as well as the limitations of those methodologies.

Module Objectives

After completing this module, you will be able to:

  • Explain how you determine whether a water body is navigable in law due to tidal influence
  • Describe how you determine whether waters are navigable in fact
  • Discuss methods of determining Public Trust boundaries in both freshwaters and tidewaters
  • List the types of evidence used to determine the former shoreline on filled lands
