VIOLATIONS

Violations of the provisions of the Act are enforceable through legal action. Criminal and civil penalties may apply. It is a crime if any officer or employee of an agency knowingly and willfully discloses individually identifiable information to any person or agency without written consent of the individual to whom the information applies. It is a crime to knowingly and willfully request or obtain any record concerning an individual from an agency under false pretenses. Requests for individually identifiable information can only be made by the individual to whom the information applies unless written consent by the individual is provided (except for parents of minors or legal guardians).  Requests for  individually identifiable information about a deceased individual are processed as a third-party FOIA request.
