ALCOAST 237/08 COMDTNOTE 12250 SUBJ: INTERIM POLICY ON COMPENSATORY TIME OFF EARNED IN LIEU OF OVERTIME PAY 1. THIS ESTABLISHES INTERIM COAST GUARD POLICY AND PROCEDURES GOVERNING COMPENSATORY TIME OFF EARNED IN LIEU OF OVERTIME PAY FOR COAST GUARD CIVILIAN EMPLOYEES PAID FROM APPROPRIATED FUNDS. MEMBERS OF THE SENIOR EXECUTIVE SERVICE (SES) AND EMPLOYEES IN ADMINISTRATIVELY DETERMINED (AD) POSITIONS ARE EXCLUDED FROM COVERAGE. THIS POLICY WILL REMAIN IN EFFECT UNTIL THE COMMANDANT INSTRUCTION IS APPROVED. COMPENSATORY TIME FOR TRAVEL, WHICH IS NEVER PAID OUT, IS NOT COVERED IN THIS INTERIM POLICY. 2. ALL EMPLOYEES MUST USE ACCRUED COMPENSATORY TIME OFF HOURS EARNED ON OR AFTER 14 MAY 2007, BY THE END OF THE 26TH PAY PERIOD AFTER THE PAY PERIOD DURING WHICH IT WAS EARNED. IF ACCRUED COMPENSATORY TIME OFF HOURS ARE NOT USED WITHIN 26 PAY PERIODS, OR IF EMPLOYEES TRANSFER TO ANOTHER AGENCY, OR SEPARATE FROM FEDERAL SERVICE BEFORE THE EXPIRATION OF THE 26 PAY PERIOD TIME LIMIT, EMPLOYEES MUST BE PAID FOR THE EARNED COMPENSATORY TIME OFF AT THE OVERTIME RATE IN EFFECT WHEN THE HOURS WERE EARNED. EMPLOYEES WILL RECEIVE PAYOUTS FOR THEIR COMPENSATORY TIME UP TO THREE PAY PERIODS AFTER THE PAY PERIOD IN WHICH THE HOURS EXPIRE, UNLESS THERE ARE SIGNIFICANT LEAVE ISSUES WHICH MUST BE RESOLVED. THE NUMBER OF HOURS AND THE AMOUNT OF THE PAYOUT WILL APPEAR ON THE LEAVE AND EARNINGS STATEMENT AS A TRANSACTION CODE 43. THE FIRST SET OF HOURS WILL EXPIRE IN PAY PERIOD 2008-10 WHICH ENDS 24 MAY 2008, FOR UNUSED HOURS EARNED 14-26 MAY 2007. EMPLOYEES WILL CONTINUE TO RECEIVE PAYOUTS IN SUBSEQUENT PAY PERIODS FOR HOURS THAT ARE NOT USED WITHIN THE REQUIRED TIME LIMITATION. A CHART IS PROVIDED AT WWW.USCG.MIL/HQ/CGPC/CPM/HOME/INDEX1.HTM TO ASSIST EMPLOYEES IN MANAGING THEIR HOURS. 3. COMPENSATORY TIME OFF HOURS CREDITED TO EMPLOYEES PRIOR TO 14 MAY 2007, MUST BE USED BY 22 MAY 2010. IF THE ACCRUED HOURS ARE NOT USED BY THIS DATE, OR IF EMPLOYEES TRANSFER TO ANOTHER AGENCY, OR SEPARATE FROM FEDERAL SERVICE, EMPLOYEES MUST BE PAID FOR THE UNUSED COMPENSATORY TIME OFF AT THE OVERTIME RATE IN EFFECT WHEN THE HOURS WERE EARNED. 4. EMPLOYEES MUST BE PAID FOR UNUSED COMPENSATORY TIME OFF HOURS WHEN THEY ARE UNABLE TO USE THE HOURS BECAUSE OF SEPARATION OR PLACEMENT IN A LEAVE WITHOUT PAY STATUS TO PERFORM SERVICE IN THE UNIFORMED SERVICES (AS DEFINED IN 38 USC 4303 AND 5 CFR 353.102) OR BECAUSE OF AN ON-THE-JOB INJURY THAT ENTITLES THEM TO INJURY COMPENSATION UNDER 5 USC, CHAPTER 81. 5. FOR EMPLOYEES HAVING BOTH PRE- AND POST- 14 MAY 2007 COMPENSATORY TIME OFF, HOURS WITH THE SHORTER TIME LIMITATION WILL BE USED FIRST. HOURS EARNED ON OR AFTER 14 MAY 2007, WILL BE USED BEFORE HOURS EARNED PRIOR TO 14 MAY 2007. 6. THERE IS NO LIMIT TO THE NUMBER OF COMPENSATORY TIME OFF HOURS EMPLOYEES MAY ACCUMULATE. THE PREVIOUS 160 HOUR LIMITATION NO LONGER APPLIES. 7. REQUESTS TO EARN COMPENSATORY TIME OFF HOURS MUST BE APPROVED BY THE SUPERVISOR ON FORM CG-4358, CIVILIAN OVERTIME AUTHORIZATION, PRIOR TO THE HOURS BEING WORKED. 8. SUPERVISORS AND EMPLOYEES ARE REMINDED THAT EMPLOYEES (EXCLUDING THOSE COVERED BY THE FAIR LABOR STANDARDS ACT) ARE SUBJECT TO A BIWEEKLY PREMIUM PAY LIMITATION, WHICH INCLUDES THE VALUE OF COMPENSATORY TIME OFF HOURS EARNED IN LIEU OF OVERTIME PAY. THE VALUE OF AN HOUR OF COMPENSATORY TIME OFF IS EQUAL TO THE OVERTIME HOURLY RATE THAT IS PAYABLE IN DOLLARS. EMPLOYEES ARE PROHIBITED FROM RECEIVING OVERTIME PAY OR COMPENSATORY TIME OFF IF IT WOULD CAUSE THE AGGREGATE RATE OF PAY FOR A PAY PERIOD TO EXCEED THE SCHEDULED RATE FOR GS-15, STEP 10, INCLUDING LOCALITY BASED PAY AND SPECIAL SALARY RATES. EMPLOYEES MAY NOT EXCEED THE BIWEEKLY PREMIUM PAY LIMITATION BY CHOOSING COMPENSATORY TIME OFF AS A SUBSTITUTE FOR MONETARY OVERTIME PAY BECAUSE THEY ARE BOTH VALUED AT THE SAME RATE. THE MAXIMUM HOURS OF COMPENSATORY TIME OFF THAT MAY BE EARNED IS THE SAME NUMBER OF OVERTIME HOURS EMPLOYEES WOULD BE ENTITLED TO RECEIVE FOR COMPENSATION AT THE OVERTIME RATE, BEFORE REACHING THE AGGREGATE PREMIUM PAY LIMITATION FOR THE PAY PERIOD IN WHICH THE OVERTIME WORK WAS PERFORMED. LOCAL UNIT COMMANDING OFFICERS/CIVILIAN RESOURCE OFFICIALS ARE REMINDED OF THEIR RESPONSIBILITY TO AFFECT INTERNAL CONTROL MONITORING PROCEDURES IN MANAGING COMPENSATORY TIME PAYMENTS PRESCRIBED IN PARAGRAPH 4.B(1) OF MANAGEMENT OF CIVILIAN OVERTIME, COMDTINST 12550.4(SERIES). EACH LEVEL OF COMMAND IS RESPONSIBLE FOR PERIODIC REVIEW, EVALUATION, AND CONTINUING IMPROVEMENT OF ITS INTERNAL COMPENSATORY TIME/OVERTIME PAY CONTROL SYSTEM. 10.
