CREDIT FOR PRIOR CIVILIAN WORK EXPERIENCE AND ACTIVE DUTY UNIFORMED SERVICE NOT OTHERWISE CREDITABLE IN DETERMINATING ENHANCED RATES OF ANNUAL LEAVE ACCRUAL, COMDTINST 12630.2 1. SIGNED 7 MARCH 2008, REF (A) SETS COAST GUARD POLICY AND PROCEDURES GOVERNING THE DETERMINATION OF ENHANCED ANNUAL LEAVE ACCRUAL RATES OF COAST GUARD CIVILIAN EMPLOYEES PAID FROM APPROPRIATED FUNDS AND APPOINTED TO DIFFICULT-TO-FILL POSITIONS. IN REQUESTING THIS INCENTIVE, RESPONSIBLE OFFICIALS MUST DETERMINE WHETHER A CANDIDATES SKILLS AND EXPERIENCE, ACQUIRED IN A CIVILIAN JOB OR ON ACTIVE DUTY PRIOR TO RETIREMENT FROM A UNIFORMED SERVICE, DIRECTLY RELATE TO THE DUTIES OF THE POSITION FOR WHICH THE CANDIDATE IS BEING CONSIDERED, AND WHETHER THOSE SKILLS AND EXPERIENCE ENABLE THE COAST GUARD TO ACCOMPLISH AN IMPORTANT MISSION OR PERFORMANCE GOAL. THIS AUTHORITY IS A RECRUITMENT INCENTIVE AND, AS IS TRUE WITH ALL RECRUITMENT AND RETENTION INCENTIVES, MUST NOT BE USED ROUTINELY. APPROVAL OF THIS INCENTIVE WILL BE CONSIDERED PART OF THE TOTAL COMPENSATION PACKAGE OFFERED TO THE CANDIDATE. THE AUTHORITY TO APPROVE ENHANCED RATES OF ANNUAL LEAVE IS DELEGATED TO CG-121. 2. IN ACCORDANCE WITH PARAGRAPH 9.C. OF REF (A), AN EMPLOYEE RECEIVING HIS OR HER FIRST APPOINTMENT AS A CIVILIAN EMPLOYEE WITH THE U.S. COAST GUARD BETWEEN 28 APRIL 2005, WHEN INTERIM REGULATIONS WERE ISSUED AND 18 OCTOBER 2006, THE EFFECTIVE DATE OF THE FINAL REGULATIONS, OR WHO WAS REAPPOINTED BETWEEN THOSE DATES AFTER A BREAK IN SERVICE OF 90 DAYS OR MORE, MAY BE GRANTED AN ENHANCED ACCRUAL RATE OF ANNUAL LEAVE FOLLOWING THIS APPOINTMENT OR REAPPOINTMENT. HOWEVER, ALL OF THE REQUIREMENTS OF REF (A) MUST HAVE BEEN MET AND THE EMPLOYEES SUPERVISOR MUST SHOW THAT THE EMPLOYEE WOULD NOT HAVE ACCEPTED THIS APPOINTMENT OR REAPPOINTMENT ABSENT AN UNDERSTANDING THAT HE OR SHE WOULD BE SUBSEQUENTLY CONSIDER FOR AN ENHANCED RATE OF ANNUAL LEAVE ACCRUAL. THERE ARE NO OTHER PROVISIONS FOR RETROACTIVITY. THE FINAL REGULATIONS INCLUDE THE REQUIREMENT THAT AGENCIES MAKE THE DETERMINATION TO APPROVE AN EMPLOYEES QUALIFYING WORK EXPERIENCE FOR PURPOSES OF AN ENHANCED RATE OF ANNUAL LEAVE ACCRUAL BEFORE THE EMPLOYEE ENTERS ON DUTY. 3. THIS INCENTIVE WILL BE PROVIDED ON A CASE-BY-CASE BASIS, AS OUTLINED IN REF (A), FOR DIFFICULT-TO-FILL POSITIONS. A DETERMINATION THAT A PARTICULAR POSITION IS DIFFICULT TO FILL WILL BE BASED ON THE FOLLOWING FACTORS: INADEQUATE NUMBERS OF QUALIFIED APPLICANTS IN THE LOCAL COMMUTING AREA, HIGH TURNOVER AND LOW RETENTION RATES, MINIMAL RESULTS FROM REPEATED ADVERTISEMENTS (VACANCY ANNOUNCEMENTS), HIGH DECLINATION RATES, HIGH TURNOVER IN SIMILAR POSITIONS, AND THE TOTAL COMPENSATION PACKAGE OFFERED TO THE APPLICANT. ADDITIONAL ANNUAL LEAVE CREDIT MAY BE GRANTED IN LIEU OF, OR IN ADDITION TO, A RECRUITMENT INCENTIVE, AND/OR A SUPERIOR QUALIFICATIONS APPOINTMENT. 4. CREDIT GRANTED TO AN EMPLOYEE FOR NON-FEDERAL SERVICE OR ACTIVE DUTY UNIFORMED SERVICE REMAINS TO THE CREDIT OF THE EMPLOYEE UNLESS HE OR SHE FAILS TO COMPLETE ONE FULL YEAR OF CONTINUOUS SERVICE WITH DHS. IF AN EMPLOYEE SEPARATES FROM FEDERAL SERVICE OR TRANSFERS TO ANOTHER FEDERAL AGENCY, PRIOR TO COMPLETING ONE FULL YEAR OF CONTINUOUS SERVICE WITH DHS, THE EMPLOYEE IS NOT ENTITLED TO RETAIN THE SERVICE CREDIT. THE COAST GUARD MUST SUBTRACT THE ADDITIONAL SERVICE CREDIT FROM THE EMPLOYEES TOTAL CREDITABLE SERVICE, AND A NEW SERVICE COMPUTATION DATE FOR LEAVE MUST BE ESTABLISHED BEFORE THE EMPLOYEE SEPARATES OR TRANSFERS TO THE NEW FEDERAL AGENCY. THE COAST GUARD MUST TRANSFER THE ANNUAL LEAVE BALANCE TO THE NEW FEDERAL AGENCY IF THE EMPLOYEE IS TRANSFERRING TO A POSITION TO WHICH ANNUAL LEAVE MAY BE TRANSFERRED, OR PROVIDE A LUMP-SUM PAYMENT FOR UNUSED ANNUAL LEAVE IF THE EMPLOYEE IS SEPARATING FROM FEDERAL SERVICE OR MOVING TO A NEW POSITION TO WHICH ANNUAL LEAVE CANNOT BE TRANSFERRED. 5.
