Chapter 3: Alaska Natural Gas Transportation System

3.1 Purpose. This chapter provides delegations of authority to various Department officials in carrying out assigned supervisory and management responsibilities related to the Alaska Natural Gas Transportation System (ANGTS). These authorities were previously delegated in Secretary=s Order 3068, dated August 28, 1981.

3.2 Authority. The delegations made in this chapter are based on the authorities provided by Section 2 of Reorganization Plan No. 3 of 1950 (64 Stat. 1262) and Section 28 of the Mineral Leasing Act of 1920, as amended, 30 U.S.C. 185.

3.3 Delegation.

A. Assistant Secretary, Land and Minerals Management. All authority granted to the Secretary of the Interior by 15 U.S.C. 719 et seq. (the Alaska Natural Gas Transportation Act); 30 U.S.C. 185, Section 28 (the Mineral Leasing Act of 1920, as amended); 43 U.S.C. 1651 et seq. (the Trans-Alaska Pipeline Authorization Act); and 43 U.S.C. 1701 et seq. (the Federal Land Policy and Management Act of 1976) is hereby delegated to the Assistant Secretary, Land and Minerals Management.

B. Director, Bureau of Land Management. Subject to the supervisory authority of the Assistant Secretary, Land and Minerals Management, the authority granted to the Secretary of the Interior by 15 U.S.C. 719 et seq. (the Alaska Natural Gas Transportation Act); 30 U.S.C. 185, Section 28 (the Mineral Leasing Act of 1920, as amended); 43 U.S.C. 1651 et seq. (the Trans-Alaska Pipeline Authorization Act); and 43 U.S.C. 1701 et seq. (the Federal Land Policy and Management Act of 1976) is hereby delegated to the Director, Bureau of Land Management. Excepted is any authority of the Secretary of the Interior reserved to the Secretary in right-of-way grants, permits, or other authorizations heretofore or hereafter issued by the Department for ANGTS; the authority of the Secretary to amend or modify the right-of-way grants issued by the Department for ANGTS; and, during the period of construction and initial operation of ANGTS, the authority delegated to the Federal Inspector in the right-of-way grants, permits, and other authorizations issued by the Department for the ANGTS.

C. Agency Authorized Officer, ANGTS. The Agency Authorized Officer, subject to the supervisory authority of the Director, Bureau of Land Management and the Assistant Secretary, Land and Minerals Management, shall represent the Department in matters involving the Office of the Federal Inspector, ANGTS.

D. Redelegation. The authority granted in 207 DM 3.3A, B, and C may be redelegated.
