4.1 Policy. Reprints of published papers, including papers that have appeared in non-Government publications, may be obtained when useful as a source of information or for the dissemination of information.

4.2 Specific Legal Authority. The Comptroller General has held (7 Comp. Gen. 221) that the reprinting of extracts from publications constitutes "printing" subject to the restrictions imposed in 44 U.S.C. 111 explained and implemented in 314 DM) in the absence of specific legal authority for the purchase of reprints. The Department of the Interior has such authority under Section 104 of its current (1972) appropriation act. Authority to purchase reprints in future years will be contingent on the retention of this authorization in later legislation.

4.3 Copyright Infringement. No copyright may subsist in any paper written by an employee of the Department in the performance of his duties as such writings are in the public domain. This principle is equally applicable to papers prepared by contractors and grantees of the Department. Hence, when a publisher obtains a copyright in a publication that includes a paper submitted by the Government, the copyright will not be effective as to the text of the Government paper. In instances in which a paper the Department wishes to reprint is covered by copyright, 454 DM 1 will apply.

4.4 Obtaining Reprints. It will usually be found that the publishers of Government papers are a convenient source of reprints. In some instances, publishers furnish authors and sponsors a reasonable number of reprints gratis as a courtesy. It is customary for publishers, upon request, to furnish to those who pay page charges a stipulated number of reprints without further charge. When reprints are required, arrangements will be made either to have them printed by the Government Printing Office or by other Government means (in accordance with 314 DM) or procured from the publisher (if specific legislative authority is currently in effect) depending on which method is determined to be more advantageous to the Government.
