Chapter 11: Federal Assistance Awards

11.1 Assistance Authority. The Director, U.S. Geological Survey, may enter into grant agreements and cooperative agreements for authorized program purposes to the extent provided by Public Law 98-242 or other relevant statutory authority, subject to the limitation in 220 DM 11.2.

11.2 Limitation. All proposed assistance programs estimated to obligate $3,000,000 or more in a fiscal year and all proposed individual assistance awards estimated to equal or exceed $3,000,000 in total Government funding shall be submitted to the Assistant Secretry - Water and Science for review and approval. This approval will occur as early as possible in the award cycle, and prior to the issuance of any public notice, program announcement, or request for applications or proposals. In the case of unsolicited proposals (applications), the review will be made prior to entering into negotiations with the applicants.

Approval by the Director will be obtained for assistance programs below this threshold but estimated to equal or exceed $500,000. An information copy of each such approval will be provided to the Assistant Secretary - Water and Science.

11.3 Personal Property. Title to personal property acquired with funds provided under contracts, grant agreements, and cooperative agreements may be vested in a nonprofit institution of higher education or in a nonprofit organization whose primary purpose is conducting scientific research, pursuant to Public Law 97-258, September 13, 1982, 96 Stat. 1004, Revised Title 31 U.S.C. 6306. The authority to decide that such vesting furthers the objectives of the U.S. Geological Survey and to establish appropriate conditions for vesting title under awards of the U.S. Geological Survey is delegated to the Director, U.S. Geological Survey.
