216 DM 1
1.1 Delegation.
A. The Director, Office of Surface Mining Reclamation and Enforcement may, except as provided in 216 DM 1.2, exercise the authority of the Secretary of the Interior with respect to the Surface Mining Control and Reclamation Act of 1977 (P.L. 95-87) and amendments thereto.
B. The Director is authorized to exercise the authority of the Secretary of the Interior to issue proposed and final regulations contained in Chapter 7, Title 30, Code of Federal Regulations and to issue public notices related to administration of the Surface Mining Control and Reclamation Act of 1977 (P.L. 95-87).
1.2 Limitations. The authority granted in 216 DM 1.1 does not include:
A. Authority which the Secretary may not redelegate as set forth in 200 DM 1.
B. Approval, or disapproval of an initial state regulatory program. This does not include amendments, modifications, or suspensions in whole or in part of approved state regulatory programs.
C. Designation of lands as unsuitable for mining operations for minerals or materials other than coal and withdrawal of lands from mineral entry (Sec. 601, P.L. 95-87).
