Chapter 2: Under Secretary

209 DM 2

2.1 Delegation. Subject to the limitations in 200 DM 1, the Under Secretary is authorized to exercise all of the authority of the Secretary, including:

A. The authority to issue amendments of and additions to the material in the Code of Federal Regulations.

B. The authority delegated to the Secretary by Section 1 of Executive Order 10250, as amended.

C. The authority delegated to the Secretary by Section 204(a) of Public Law 94-579, relating to the withdrawal or reservation of certain lands by the issuance of public land orders.

D. The administration of the oath of office or any oath required by law in connection with employment.

E. All authority delegated on a functional basis published in Part 205 DM.

2.2 Authority to Redelegate. The Under Secretary may redelegate the authority delegated in 209 DM 2.1, except where prohibited by statute, Executive order, or limitations established by competent authority. Such redelegations will be issued in strict compliance with the procedural requirements in Part 200 of the Departmental Manual.

2.3 Deputy Under Secretaries.

A. In the absence of, and under conditions specified by the Under Secretary, a Deputy Under Secretary is authorized to exercise the authority of the Under Secretary, except that a Deputy Under Secretary may not exercise the authority delegated by 209 DM 2.1B and 2.1C.

B. A Deputy Under Secretary may not redelegate the authority conferred by this paragraph 209 DM 2.3.

2.4 Migratory Bird Conservation Commission. The Under Secretary of the Interior, upon designation, may exercise the authority of the Secretary of the Interior as Chairman, Migratory Bird Conservation Commission. This authority may not be redelegated.
