Chapter 2: Restrictive Trade Practices in Overseas Shipments of Property

2.1 Authority. This directive is issued pursuant to the authority of 43 U.S.C. 1457, 5 U.S.C. 301, and Reorganization Plan No. 3 of 1950 (64 Stat. 1262), and is derived from Secretary=s Order 2983 dated February 25, 1976.

2.2 Policy. Consistent with United States= opposition to any restrictive trade practices or boycott imposed or proposed by any foreign country or person or agent of a foreign country against any country friendly to the United States, bureaus and offices are directed as follows:

A. Heads of bureaus and offices having responsibilities under international agreements or programs shall assure that no data or documentary information is furnished to agents or representatives of any foreign government or business if such data or documentary information is not customarily furnished in connection with international sales or shipments and could only have been solicited for the purpose of implementing a restrictive trade practice or boycott contrary to the laws and national Policy of the United States.

B. Under international agreements or programs in which this Department is involved, the selection of suppliers of materials, equipment and services is to be made solely upon the basis of United States laws and policies.

C. Any doubts or questions as to the propriety of existing or planned practices or procedures shall be referred immediately to the Office of the Solicitor for review and advice prior to implementation.
