General Provisions & Definitions
The provisions and definitions in this Regulation are applicable to all District Regulations and are in addition to the provisions and definitions in individual Rules and Regulations. Regulation I includes sections on exclusions, breakdown procedures, definition of terms, registration, right of access, sampling facilities, record maintenance, and many other provisions.  Last Amended 7/19/2006

Notice to Comply
Establishes guidelines for implementing and conducting a Notice to Comply element within the Enforcement program.  Adopted 2/3/1999

  Permits
This Regulation specifies the requirements for Authorities to Construct and Permits to Operate.

General Requirements
Includes criteria for issuance or denial of permits, exemptions, appeals against decisions of the APCO and District actions on applications.  Last Amended 7/19/2006

New Source Review
Applies to new or modified sources. Rule 2 contains requirements for Best Available Control Technology and emission offsets. Rule 2 implements federal New Source Review and Prevention of Significant Deterioration requirements.  Last Amended 6/15/2005

Power Plants
Contains special provisions for the review of and standards for the approval of authorities to construct power plants within the District.

Emissions Banking
Includes procedures for banking and offsets. Establishes a small facility bank for offsets for eligible facilities.  Last Amended 12/21/2004

New Source Review of Toxic Air Contaminants

Applies preconstruction permit review to new and modified sources of toxic air contaminants; contains project health risk limits and requirements for Toxics Best Available Control Technology.  Adopted 6/15/05, Effective 7/1/05

Acid Rain

Interchangeable Emission Reduction Credits
Regulates use and trading of Interchangeable Emission Reduction Credits from stationary sources of nitrogen oxides (NOx).  Last Amended 6/15/2005

Large Confined Animal Facilities
Provides requirements for agricultural sources of air pollution, and complies with the provisions of SB 700.  Adopted 7/19/2006

Fees

This Regulation establishes fees to be charged for permits, equipment registration, emissions, Hearing Board filings, and other District services.  Last Amended 7/30/2008

  Air Pollution Episode Plan
A system designed to reduce levels of air contaminants that may be harmful to health and to protect that portion of the population at risk. Establishes control and advisory procedures when specified levels have been or are forecasted to be reached at each of four stages.  Last Amended 3/20/1991

  Open Burning
Generally prohibits open burning, but also allows for exemptions such as agricultural burning, disposal of hazardous materials, fire training, and range, forest, and wildlife management.  Last Amended 03/06/02

Limits the emission of particulate matter as follows:
