PL 94-12 Tax Reduction Act of 1975 (enacted 3/29/75)

Title VII – Miscellaneous Provisions
Section 702(a) allows a $50 payment to each individual who for the month of 3/75, was entitled to a monthly insurance benefit payable under Title II or Title XVI. Such $50 payment shall be made only to individuals who were paid a benefit for 3/75 in a check issued no later than 8/31/75. No such $50 payment shall be made to any individual who is not a resident of the U.S. This payment is not considered income for SSI purposes.

PL 94-22 Travel Expense Amendments Act of 1975 (enacted 5/19/75)

Section 2(a) expands the definition of "employee," for purposes of travel, subsistence and mileage allowances, to include experts and consultants who are intermittently employed by the Federal Government, and those who serve the Government without pay or for $1 a year.

Section 3 sets the per diem travel allowance at $35 for travel within the continental U.S., and authorizes the President to set the per diem allowance by locality for travel outside the continental U.S. Raises the maximum reimbursement rate for travel to high rate geographical areas and for travel under unusual circumstances.

Section 4 provides that an employee serving intermittently in Government service as an expert or consultant and paid on a daily when-actually-employed basis, or serving without pay or at $1 a year, may be allowed travel or transportation expenses, while away from his/her home or regular place of business and at the place of employment or service.

Section 5 raises the mileage allowances for the use of privately owned motorcycles, automobiles and airplanes when such modes of transportation have been approved as most advantageous to the Government.

Section 6 states that regulations related to this statute shall be issued no later than 30 days after date of enactment.

 

PL 94-32 Second Supplemental Appropriations Act, 1975 (enacted 6/12/75)

Title I
Chapter VI
Social Security Administration
Provides an additional amount of $80,844,000 for “Special benefits for disabled coal miners” and provides an additional $83,102,000 for the SSI program. The appointments of ALJs for this program shall terminate no later than 12/31/76.

Title II – Increased Pay Costs for the FY 1975
Social Security Administration
Provides an increase of $42,590,000 in the limitation on salaries and expenses paid from Trust Funds and $807,000 for disabled coal miners.

 

PL 94-41 Second Supplemental Appropriations Act. 1976 (enacted 6/27/75)

Making continuing appropriations for FY 1976 at FY 1975 levels until enactment of permanent FY 1976 appropriations. Effective 7/1/75 – 12/19/75.

 

PL 94-44 An Act to amend section 1113 of the Social Security Act to make permanent the program of temporary assistance for U.S. citizens returned from abroad, subject to specific limitations on the aggregate dollar amount of such assistance which may be provided and on the period for which such assistance may be furnished in any particular case. (enacted 6/28/75)

Section 3 extends through 6/30/76, the eligibility of SSI recipients to receive food stamps.

 

PL 94-47 An Act to increase the temporary debt limitation until November 15, 1975. (enacted 6/30/75)

Increases the temporary public debt limit until 11/15/75, by $177,000,000,000.

 

PL 94-48 An Act to amend title XIX of the Social Security Act to extend the protection against the loss of Medicaid because of the 1972 increase in social security benefits, and to extend the exemption of Puerto Rico, Guam, and the Virgin Islands from certain requirements relating to choice of provider. (enacted 7/1/75)

Section 1 stipulates that any individual for the month of 8/72, receiving or eligible for Title XVI benefits, and who for such month was entitled to monthly benefits under Title II shall be deemed to be eligible for financial aid or assistance for any month thereafter if such individual would have been eligible for financial aid or assistance had the increase in monthly insurance benefits under Title II resulting from enactment of PL 92-336 not been applicable to such individual.

 

PL 94-82 An Act to amend title 39 US Code, to apply to the U.S. Postal Service certain provisions of law providing for Federal agency safety programs and responsibilities. (enacted 8/9/75)

Title II - Executive Salary Cost-of-Living Adjustment Act Section 202(a) provides a new method for annual adjustment of rates of pay for each level of the Executive Schedule. States that the adjustment would become effective whenever a comparability adjustment is made under present provisions in the statutory salary systems (normally in October of each year). Provides that the amount of the adjustment would equal the percentage of the comparability adjustment, rounded to the nearest $100.

 

PL 94-88 An Act to amend the Tariff Schedules of the U.S. to provide duty free treatment to watches and watch movements manufactured in any insular possession of the U.S. if foreign materials do not exceed 70 % of the total value of such watches and movements. (enacted 8/9/75)

Section 207 provides safeguards which restrict the use or disclosure of information concerning applicants or recipients to purposes directly connected with the SSI program. Effective 8/1/75.

 

PL 94-114 An Act to declare that certain submarginal land of the U.S. shall be held in trust for certain Indian tribes and be made a part of the reservations of said Indians. (enacted 10/17/75)

Section 6 excludes income and gross receipts from property held in trust by the United States for Indian tribes from being utilized as the basis for denying or reducing the financial assistance or other benefits to which such member or his household would otherwise be entitled to under the Social Security Act or any other Federal or federally-assisted program.

 

PL 94-132 An Act to increase the temporary debt limitation until March 15, 1976. (enacted 11/14/75)

Increases the temporary public debt limit until 3/15/76, by $195,000,000,000.

 

PL 94-136 National Productivity and Quality of Working Life Act of 1975 (enacted 11/28/75)

Title III- Federal Agency Coordination and Liaison with Center
Section 301(a) directs each Federal agency to designate an individual to serve as liaison with the National Center for Productivity and Quality of Working Life.
Section 301(b) directs each Federal agency to keep the Center informed of all programs and initiatives relevant to this Act.
Section 301(c) directs each Federal agency to provide the Center with any information and materials which it may request.
Section 302 directs each Federal agency to study and review the promulgation and implementation of its statutory authority, policies, and regulations, and shall identify those which adversely affect productivity growth in the public or private sector.
Section 303 directs each Federal agency to make advice, information, and support, including financial, available to State and local governments, labor organizations, industry, and public institutions, in order to enhance productivity in the public and private sectors.
Section 304 directs each Federal agency to identify, initiate, and support appropriate programs, systems, procedures, policies, and techniques to improve productivity.
Section 305 provides that nothing in this Title affects any specific obligation of any Federal agency (1) to coordinate or consult with any other Federal or State agency or (2) to act, or to refrain from acting, contingent upon the recommendations or certification of any other Federal or State agency.

 

PL 94-144 An Act to authorize appropriations for the period July 1, 1976 through September 30, 1976. (enacted 12/9/75)

Making appropriations for FY 1976 and such sums as may be necessary to conduct programs and activities for which funding was authorized on 6/30/76. Effective 7/1/76 – 9/30/76.

PL 94-166 An Act to provide for allotment or assignment of payments from civil service annuities. (enacted 12/23/75)

Permits an individual entitled to a civil service annuity to make such allotments or assignments of amounts from his annuity for such purposes as the CSC considers appropriate.

PL 94-172 An Act to amend title 5, US Code, to provide that annual leave lost by a Federal employee because of an unjustified or unwarranted personnel action shall be restored to the employee. (enacted 12/23/75)

Section 1(a) provides that an employee of an agency found, on or after 3/30/66, to have undergone an unjustified or unwarranted personnel action shall be deemed to have performed service for the agency during the period of such action. Allows the restoration of annual leave in excess of the maximum leave accumulation permitted by law. Credits such leave to a separate account which shall be available for use by the employee within the time limits prescribed by Civil Service regulation.
Section 2 provides for liquidation by lump-sum payment of leave which was not credited to a former employee if such employee is not on the rolls on the date of the enactment of this Act.

 

PL 94-183 An Act to amend Chapter 83 of title 5, US Code, to establish time limitations in applying for civil service retirement benefits. (enacted 12/31/75)

Amends Title 5 U.S.C. Section 8345 to provide that: (1) no payment shall be made from the civil service retirement fund unless an application for benefits based on the service of a Federal employee is received in the CSC before the one hundred and fifteenth anniversary of his birth; (2) that after the death of a Federal employee, or annuitant, no benefit based on his service shall be paid from the fund unless an application thereafter is received in the CSC within 30 years after the death or other event which gives rise to title to the benefit.

 

PL 94-202 An Act to amend the Social Security Act to expedite the holding of hearings under titles IIXVI, XVIII by establishing uniform review procedures under such titles. (enacted 1/2/76)

Section 1 directs the HEW Sec. to make findings of fact and decisions as to the rights of any individual applying for SSI payment under Title XVI, and to provide notice and opportunity for a hearing to eligible individuals under such Title who disagree with a decision of the HEW Sec. as to eligibility.
Section 3 authorizes SSI hearing examiners to serve as hearing examiners under Titles II, XVI, and XVIII, until 12/31/78, if the HEW Sec. finds such action will promote the objectives of such Titles.
Section 4 allows 60 days for an individual to request review of a decision regarding Social Security or Medicare eligibility. Effective with respect to decisions or determinations of which notice is received, by the individual requesting the hearing, after 2/29/76.
Section 6(a) authorizes modification, at any time prior to 1977, of an agreement with West Virginia to permit policemen and firemen of such State to be covered by Title II.
Section 7 provides that no regulation, and no modification of any regulation promulgated by the HEW Sec. after date of enactment that pertains, directly or indirectly, to the frequency or due dates for payments and reports required under Section 218(e) of the Social Security Act, shall become effective prior to the end of the 18 month period which begins with the first day of the first calendar month which begins after the date of publication in the Federal Register.
Section 8(b) directs the Treasury Sec. to make available information returns filed by employers pursuant to the IRS (reporting wages paid subject to Social Security taxes) to the HEW Sec. for the purposes of Titles II and XI. Authorizes the two Secretaries to enter into an agreement for the processing by the HEW Sec. of such information returns. (This change permits the shift to annual wage reporting of worker’s wages directly to SSA.) Effective with respect to statements reporting income received after 1977. Section 8(h) provides that the determination of increases in the maximum amount of earnings subject to Social Security taxes and of the amount of annual earnings allowed a beneficiary before deductions from benefits occur under the retirement test provisions shall be computed with reference to the increases in average annual wages of all employees (rather than increases in first quarter wages for all employees).
Section 9 provides that periodic payments received pursuant to a State program established prior to 7/1/73, shall not be considered income for purposes of OASDI if such payments are made by the State of which the individual receiving such payments is a resident, and if eligibility of any individual for such payments is not based on need and is based solely on attainment of age 65 and duration of residence in such State by such individual.

 

PL 94-206 Departments of Labor and Health, Education, and Welfare Appropriation Act, 1976 (enacted 1/28/76)

Title II
Social Security Administration
Provides an additional amount of $880,940,000 for “Payments to the Social Security Trust and Other Funds” for the period 7/1/76 – 9/30/76.

Provides an additional amount of $234,600,000 for “Special benefits for disabled coal miners” for the period 7/1/76 – 9/30/76. Provides an additional amount of $1,503,541,000 for “SSI program” for the period 7/1/76 – 9/30/76 and $5,518,523,000 for administrative expenses incurred. Provides that whenever the COSS finds it will promote the achievement of the provisions of Title IV of the Federal Coal Mine Health and Safety Act of 1969, qualified persons may be appointed to conduct hearings without meeting the requirements for ALJs appointed under 5 U.S.C. Section 3105 but such appointments shall terminate no later than 12/31/76. Provides $2,373,133,612 required to pay travel expenses for medical examinations, necessary witnesses, and reconsideration interviews and to proceedings before ALJs. Provides for an additional amount of $629,900,403 for “Limitation on salaries and expenses” for the period 7/1/76 – 9/30/76. Provides for an additional amount of $3,633,000 for “Limitation on construction” for the period 7/1/76 – 9/30/76.

 

PL 94-232 An Act to increase the temporary debt limit until July 31, 1976. (enacted 3/15/76)

Increases the public debt limit until 6/30/76, by $227,000,000,000.

 

PL 94-241 Joint resolution to approve the "Covenant to Establish a Commonwealth of Northern Mariana Islands in Political Union With the United States of America". (enacted 3/24/76

 

Article VI – Revenue and Taxation Section 606(a) directs that the Trust Territory Social Security Retirement Fund attributable to the Northern Mariana Islands be transferred to the U.S. Treasury, to be held in trust as a separate fund and to be known as the "Northern Mariana Islands Social Security Retirement Fund." Provides that the Fund will be administered by the U.S. in accordance with the Social Security laws of the Trust Territory of the Pacific Islands.

Revises the Fiscal Year provisions of specified public laws in order to bring them into conformance with the October - September Fiscal Year.

Grants court leave to Federal employees when called as witnesses in certain judicial proceedings. Effective 10/1/76.

 

PL 94-313 An Act to amend the Indochina Migration and Refugee Assistance Act of 1975, to provide for the inclusion of refugees from Laos. (enacted 6/21/76)

Makes refugees from Laos eligible for resettlement, health care, education, public assistance, including SSI, and other benefits of the Indochina Migration and Refugee Assistance Act.

 

PL 94-331 An Act to amend section 815 of the Internal Revenue Code to allow a life insurance company to disregard a distribution during the last month of its taxable year, determined to have been made out of the policyholders surplus account, if such distribution is returned to the company not later than the due date for filing its income tax return for that year. (enacted 6/30/76)

Section 2 excludes from countable income under the SSI program assistance received under the Disaster Relief Act of 1974 or other assistance under a major disaster declared by the President. Effective 6/1/76 – 12/31/76.
Section 4 amends the Social Security Act to provide that SSI recipients who leave their households because of a major disaster will not be charged with any support maintenance in their new living arrangement. Effective 6/1/76 – 12/31/76.

 

PL 94-334 An Act to increase the temporary debt limit. (enacted 6/30/76)

Increases the temporary public debt limit for the period 7/1/76 – 9/30/76, by $236,000,000,000. Increases the temporary public debt limit for the period 10/1/76 – 3/31/77, by $282,000,000,000. Increases the temporary public debt limit for the period 4/1/77 – 9/30/77, by $300,000,000,000.

 

PL 94-342 An Act to amend title 5, US Code, to restore eligibility for health benefits coverage to certain individuals whose survivor annuities are restored. (enacted 7/6/76)

Section 1(a) permits a surviving spouse whose civil service annuity was terminated due to remarriage to enroll in a civil service health benefits plan upon restoration of such spouse's annuity if the spouse was covered by a health benefits plan at the time the annuity was terminated. Effective 10/1/76.

 

PL 94-356 Nuclear Career Incentive Act (enacted 7/12/76)

Makes permanent the authority (under PL 93-368) to reimburse States for interim assistance to SSI applicants.

 

PL 94-358 An Act to amend title 5 of the US Code to provide that the provisions relating to the withholding of city income or employment taxes from Federal employees shall apply to taxes imposed by certain nonincorporated local governments. (enacted 7/12/76)

Provides that the provisions relating to the withholding of city income or employment taxes from Federal employees shall apply to taxes imposed by non-incorporated local governments functioning in a way similar to a municipality.

PL 94-365 An Act to make permanent the existing temporary authority for reimbursement of States for interim assistance payments under title XVI of the Social Security Act, to extend for 1 year the eligibility of supplemental security income recipients for food stamps, and to extend for 1 year the period during which payments may be made to States for child support collection services under part D of title IV of such act. (enacted 7/14/76)

Section 1 makes permanent the existing temporary authority under Title XVI for interim assistance payments from States to individuals while the applications of such individuals for SSI are pending.
Section 2 extends for one year, until 6/30/77, the eligibility of SSI recipients for food stamps.

 

PL 94-375 Housing Amendments (enacted 8/3/76)

Excludes from income and resources under the SSI program the value of assistance provided under several Federal housing programs.

 

PL 94-379 An Act to permit a State which no longer qualifies for hold harmless treatment under the supplemental security income program to elect to remain a food stamp cash-out State upon condition that it pass though a part of the 1976 cost-of-living increase in SSI benefits and all of any subsequent increases in such benefits. (enacted 8/10/76)

Authorizes the State of California to elect not to implement the food stamp program for beneficiaries of SSI but to provide instead for a higher level of State supplementary benefits under Title XVI.

 

PL 94-397 An Act to clarify the application of section 8344 of title 5, US Code, relating to civil service annuities and pay upon reemployment, and for other purposes. (enacted 9/3/76)

Section 1(a) provides that an involuntary retiree who is reemployed in a position in which he is not subject to the civil service retirement provisions shall continue to receive his full annuity but his salary will be reduced by an amount equal to his annuity allocable to the period of actual employment. Requires agencies to deposit in the Treasury to the credit of the civil service retirement fund amounts, equal to annuities that are deducted from the salaries of reemployed annuitants. Requires that if an annuitant, whose annuity is based on an involuntary separation, is reemployed in a position in which he is subject to the civil service retirement provisions, the payment of his annuity terminates on reemployment. Provides that the annuitant's annuity will be terminated upon reemployment, the employing agency will withhold retirement deductions from the annuitant's pay, and future annuity rights will be determined under the law in effect at the time of separation from reemployment. Effective on the date of enactment or 10/1/76, whichever is later, but shall not apply to any annuitant reemployed before such date.

 

PL 94-409 Government in the Sunshine Act (enacted 9/13/76)

Section 2 declares that it is the policy of Congress that the public is entitled to the fullest practicable information regarding the decision-making process of the Federal Government and that providing such information is the purpose of this Act . Effective 180 days after the date of enactment.
Section 3(b) provides that members of a Federal agency shall not jointly conduct or dispose of agency business in a meeting other than in accordance with this Act. Requires every portion of every meeting of an agency to be open to public observation except under enumerated conditions. Requires that a meeting shall be closed only after a majority of the entire membership of the agency votes to take such action. Directs the agency to make a public announcement, at least one week before the meeting, of the time, place, and subject matter of the meeting, whether it is to be open or closed to the public, and the name and phone number of the official designated by the agency to respond to requests for information about the meeting. Requires the General Counsel or chief legal officer of the agency to publicly certify that, in his or her opinion, the meeting may be closed to the public and to state each relevant exempted provision. Directs the agency to make a verbatim transcript or electronic recording of each meeting or portion closed to the public. Requires each agency subject to this Act to promulgate regulations. Effective 180 days after the date of enactment.
Section 4(a) prohibits ex parte communication with any individual who is or is reasonably expected to be involved in a decision-making proceeding by anyone interested in such proceeding. Effective 180 days after the date of enactment.

 

PL 94-432 Veterans and Survivors Pension Adjustment Act 1976 (enacted 9/30/76)

Requires all Federal Agencies to provide the Veterans Administration with information necessary to administer veterans programs.

 

PL 94-439 Departments of Labor and Health, Education and Welfare Appropriation Act, 1977 (enacted 9/30/76)

Title II
Social Security Administration
Provides an additional amount of $6,713,902,000 for payment to the OASDI, the Federal Hospital Insurance, and the Federal Supplementary Medical Insurance Trust funds. Provides an additional amount of $913,897,000 for carrying out Title IV of the Federal Coal Mine Health and Safety Act of 1969. Provides an additional amount of $5,895,122,000 for carrying out the SSI program. Provides an increase of $2,561,773,000 in the limitation on salaries and expenses paid from Trust Funds. Provides an additional amount of $14,400,000 for acquisition of sites, construction, and equipment of facilities.

 

PL 94-453 An Act to amend title 18 of the US Code, to prohibit deprivation of employment or other benefit for political contribution. (enacted 10/2/76)

Section 1 amends 18 U.S.C. Section 601 to prohibitthe deprivation of employment or other benefit because of political activity including refusing to make a contribution for the benefit of any candidate or any political party.
Section 4(a) amends 18 U.S.C. Chapter 13 by making it a Federal crime to deprive or threaten to deprive an individual of any employment or other benefit, provided in whole or in part by any Act of Congress appropriating funds for relief purposes, on account of political affiliation, race, color, sex, religion, or national origin.

 

PL 94-455 Tax Reform Act of 1976 (enacted 10/4/76)

Title IV - Extensions of Individual Income tax Reductions
Section 402 makes a minor technical amendment to Section 2(d) of the Revenue Adjustment Act of 1975 to disregard refunds of EIC in the administration of Federal programs and federally- assisted programs; amends Section 2(g) of the Revenue Adjustment Act of 1975 to read that amendments made by Section 2 apply to taxable years ending after 12/31/75, and before 1/1/78. Subsection (d) applies to taxable years ending after 12/31/75.

Title XII - Administrative Provisions
Section 1202 permits disclosure of returns and returns information to specified agencies for specified purposes other than tax administration. Sets forth required procedures for such disclosures of returns and return information, including records of such disclosures and measures for safeguarding returns and return information.
Section 1207 provides that boat crewmen, under specified circumstances, shall be treated as self-employed for purposes of income tax withholding, the self-employment tax, FICA, and the Social Security Act.
Section 1211 amends Section 205(c)(2) of the Social Security Act to state that it is the policy of the U.S. that any State (or political subdivision thereof) may, in the administration of any tax, general public assistance, driver’s license, or motor vehicle registration law within its jurisdiction, utilize the SSNs issued by the HEW Sec. for the purpose of establishing the identification of individuals affected by such law, and may require any individual who is or appears to be so affected to furnish to such State (or political subdivision thereof) or any agency thereof having administrative responsibility for the law involved, the SSN (or numbers, if he has more than one such number) issued to him by the HEW Sec.
(ii) any provision of Federal law that is inconsistent with the policy set forth in the subparagraph, shall on and after the date of the enactment be null, void, and of no effect.

Title XIX - Repeal and Revision of Obsolete, Rarely Used, Etc., Provisions of Internal Revenue Code of 1954
Subtitle A - Amendments of Internal Revenue Code Generally
Section 1901 revises Section 1401 of the IRC of 1954 relating to tax on self-employment income; and Section 1401 of the IRC of 1954 relating to the definition of self-employment income.
Section 1903 revises Section 3101 of the IRC of 1954 relating to the rate of tax on employees for OASDI; and Section 3111 of the IRC of 1954 relating to the rate of tax on employers for OASDI.

PL 94-489 An Act to amend the Service Contract Act of 1965 to provide that all employees, other than bona fide executives, administrative, or professional employees, shall be considered to be service employees for purposes of such act. (enacted 10/13/76)

Section 3 amends the Service Contract Act of 1965 to redefine "service employees" for purposes of Federal service contract labor standards.

 

PL 94-505 An Act to convey interests of the US in certain land in Salt Lake County, Utah to Shriners Hospital for Crippled Children, a Colorado Corporation. (enacted 10/15/76)

Established within HEW an Office of Inspector General with responsibility to direct, conduct, supervise, and establish policies dealing with audits and investigations of HEW programs and operations.

 

PL 94-519 An Act to amend the Federal property and Administrative Services Act of 1949 to permit the donation of Federal surplus personal property to the States and local organizations for public purposes. (enacted 10/17/76)

Section 1 authorizes GSA, under the Federal Property and Administrative Services Act of 1949, to donate, without cost, any surplus personal property under the control of any executive agency to the State agency in each State designated as the body responsible for the distribution of such property. GSA or the head of any Federal agency designated by GSA, and the HEW Sec. or the head of any Federal agency designated by the HEW Sec., are authorized to enter into cooperative agreements. Such cooperative agreements may provide for utilization, with or without payment or reimbursement, of the property, facilities, personnel, and services of a State agency, and for making available, with or without payment or reimbursement, property, facilities, personnel, or services of a Federal agency. Payment or reimbursement, if any, shall be credited. Any surplus property transferred to a State agency for distribution may be retained by the State agency for use in performing its functions, and unless otherwise directed by GSA, title to property so retained shall vest in the State agency.

 

PL 94-540 An Act to provide for the disposition of funds appropriated to pay a judgment in favor of the Grand River Band of Ottawa Indians in Indian Claims Commission Docket numbered 40-K, and for other purposes. (enacted 10/18/76)

Provides that funds awarded and distributed to the Ottawa Indians will not be counted as income or resources for SSI benefit purposes.

 

PL 94-563 An Act to amend chapter 21 of the Internal Revenue Code of 1954 and title II of the Social Security Act to provide that the payment of social security taxes by a nonprofit organization with respect to its employees shall constitute a constructive filing by such organization of the certificate otherwise required to provide social security coverage for such employees if it has not received a refund or credit of such taxes, and to require the filing of such a certificate by any nonprofit organization which paid such taxes but received a refund or credit because it had not previously filed such certificate. (enacted 10/19/76)

Amends the IRC of 1954 and Title II of the Social Security Act to provide that the payment of Social Security taxes by a nonprofit organization for its employees shall constitute (for both tax and benefit purposes) a constructive filing by such organization of the waiver certificate otherwise required to provide Social Security coverage for such employees if it has not received a refund or credit of such taxes. Requires the filing of such certificate by any nonprofit organization which paid such taxes but received a refund or credit because it has not previously filed such certificate. Provides that when a nonprofit organization files a valid waiver certificate, the taxes due with respect to services constituting employment by reason of such certificate, may be paid in installments.

 

PL 94-566 Unemployment Compensation Amendments of 1976 (enacted 10/20/76)

Provides for the referral of disabled and blind SSI recipients under age 16 for appropriate services. The law also requires unemployed fathers who apply for AFDC payments to collect any unemployment compensation before receiving benefits; and requires State employment offices, on a reimbursable cost basis, to furnish information to welfare agencies for the purpose of administering the AFDC and Child Support Program. Additionally, the law preserves Medicaid eligibility for individuals who become ineligible for SSI payments because of cost-of-living increases in Social Security benefits in June 1977 and later; authorizes SSI payments to persons in publicly operated community residences serving no more than 16 persons and excludes from income assistance based on need (including vendor payments) made to or on behalf of SSI recipients by State or local governments; and, disregards for purposes of determining the amount which the Federal Government must contribute toward the cost of supplementary benefits provided by each of the three “hold-harmless” States, and any increases in Federal SSI benefits becoming effective after June 30, 1977, and before July 1, 1979.

 

PL 94-569 An Act to amend the Internal Revenue Code of 1954 to permit the authorization of means other than stamps on containers of distilled spirits as evidence of tax payment. (enacted 10/20/76)

Excludes the value of a home in which an individual resides from the determination of the individual’s resources; and, authorizes the payment of SSI benefits for up to three months to presumptively blind applicants.

 

PL 94-575 Federal Records Management Amendments of 1976 (enacted 10/21/76)

Section 2 declares it to be the purpose of this Act to establish standards and procedures to assure efficient and effective records management. Directs the GSA to provide guidance and assistance to Federal agencies with respect to records creation, records maintenance and use, and records disposition. Requires GSA to direct the continuing attention of Federal agencies and the Congress to the burden placed on the Federal Government by unnecessary paperwork, and to the need for adequate policies governing records creation, maintenance and use, and disposition. Authorizes GSA to inspect the records or the records management practices and programs of any Federal agency solely for the purpose of rendering recommendations for the improvement of records management practices and programs. Authorizes GSA to establish, maintain, and operate records centers and centralized microfilming services for Federal agencies.

 

PL 94-581 An Act to amend title 38 of the US Code in order to provide for an annual investigation by the Administrator into the cost of travel by veterans to Veterans’ Administration facilities and to set rates therefore. (enacted 10/21/76)

Clarified the legal basis for reimbursement made by SSA for services furnished to Medicare- eligible patients in certain Veterans Administration hospitals under sharing agreements with non-VA hospitals.

 

PL 94-585 An Act to amend the Internal Revenue Code of 1954 with respect to influencing legislation by public charities. (enacted 10/21/76)

Amends the Social Security Act to make public assistance withholding procedures optional for any State plan for aid and services to needy families with children where a recipient household requests that such procedures be utilized. Requires States, on or after 6/30/77, to pass through cost-of-living increases to recipients of SSI benefits.
