Federal Acquisition Regulation Provisions and Clauses for Purchasing Energy Star/Energy Efficient Products
On November 23, 2007, the Federal Acquisition Regulation was amended to add provisions for implementing section 104 of the Energy Policy Act of 2005 (EPAct), which requires Federal agencies to purchase Energy Star or Federal Energy Management Program-designated energy efficient products. Among other things, the new FAR provisions make clear that agencies must purchase these products unless the head of the agency determines in writing that energy efficient products meeting the agency's needs are not reasonably available or cost effective. The FAR amendments also include an "energy-consuming products" contract clause.
