ENFORCEMENT PROCEEDINGS

In the Matter of Diatect International Corporation

An Administrative Law Judge has issued an Initial Decision in the matter of Diatect International Corporation. The Order Instituting Proceedings alleged that the Respondent failed to file required annual and quarterly reports with the Securities and Exchange Commission, in violation of Section 13(a) of the Securities Exchange Act of 1934 (Exchange Act) and Exchange Act Rules 13a-1 and 13a-13. The Initial Decision finds that Diatect International Corporation (Diatect) violated Section 13(a) of the Exchange Act and Exchange Act Rules 13a-1 and 13a-13, as alleged. However, while the proceeding was pending, Diatect became current in its annual and quarterly reporting obligations. The Initial Decision concludes that neither of the two permissible sanctions under Section 12(j) of the Exchange Act, revocation of Diatect's registered securities or suspension of registration for twelve months or less, is necessary or appropriate for the protection of investors. A proposed rule change (SR-NYSE-2008-06) filed by the New York Stock Exchange to implement transaction fees for NYSE MatchPoint has become effective under Section 19(b)(3)(A) of the Securities Exchange Act of 1934. A proposed rule change filed by the Financial Industry Regulatory Authority (SR-FINRA-2008-003) to extend the pilot regarding the use of multiple MPIDs on the Trade Reporting Facilities and on the Alternative Display Facility has become effective under Section 19(b)(3)(A) of the Securities Exchange Act of 1934. Publication is expected in the Federal Register during the week of Feb. 4, 2008. (Rel. 34-57217)
