Former administrator jailed for child porn
Ex-Washington Twp. official sentenced to 20 months in prison, five years probation and a $2,500 fine.

DAYTON — — Former Washington Twp. Deputy Administrator Tom Toberen was sentenced Wednesday in federal court to 20 months in prison, five years probation and fined $2,500 for possession of child pornography.

He also will have to register as a sex offender when he is released from prison, said U.S. District Judge Thomas M. Rose.

Toberen, 51, will be allowed to surrender to U.S. marshals, who will notify him when and where to report in about 30 days, Rose said.

Toberen resigned in October after pleading guilty to a one-count bill of information charging him with possession of child pornography.

He admitted to having about 234 depictions of children under age 18 engaged in sexually explicit conduct on or about May 18, 2005. They included 20 still images on the hard drive of a computer in his residence, 188 still images on a computer storage disk and 26 images in e-mail folders belonging to him.

Rose said he considered that Toberen did not generate the images and did not attempt to contact any underage individuals, but that Toberen did trade images of child pornography on the Internet.

"I'm heartbroken," Toberen's mother, 80-year-old Sonia Toberen of Kettering, said after the sentencing.

Toberen's attorney, Dennis Adkins, had her testify on her son's behalf. "He's all I have. I have no other family," she said. "I couldn't ask for a better son. He's never been a problem."

Just before he was sentenced, Toberen was allowed to address the court.

"The past year and a half has been very difficult for me and a very stressful time," he said.

"I've lost much in the last few months, but I also learned a great deal about friends. I'm just a good person who made a mistake. I take full responsibility for what I've done."

He ended by asking Rose for leniency so he can return to work and "be a productive person."
