PLEASE TAKE NOTICE THAT state law requires all retail and non-retail gasoline dispensing facilities equip their underground storage tanks with Phase II Enhanced Vapor Recovery systems on or before April 1, 2009.
If you have not installed Phase II Enhanced Vapor Recovery on your underground storage tanks you have 3 options:
Option 1: |
• Submit an application ( Gasoline Dispensing Facility Application ) for permit modification to the AVAQMD prior to April 1, 2009 along with a $363 permit application fee. |

• Receive Authority to Construct Permit from AVAQMD |
|
• Install the Phase II Enhanced Vapor Recovery System before April 1, 2009 . |
Option 2: |
• Submit an application ( Gasoline Dispensing Facility Application ) for permit modification to the AVAQMD prior to April 1, 2009 along with a $363 permit application fee. |

• Submit a Compliance Plan ( EVR Compliance Plan ) showing when the required Phase II Enhanced Vapor Recovery System installation will be completed. |
|
• Receive Authority to Construct Permit from AVAQMD and District approved Compliance Plan prior to April 1, 2009 . |
|
• Complete the Phase II Enhanced Vapor Recovery System installation pursuant to the date and information provided on approved Compliance Plan. |
|
• Incur weekly minimum civil penalty of $100 per week after April 1, 2009 until the project is complete. |
Option 3: |
Do nothing until April 1, 2009 and be tagged “out of service” and unable to dispense gasoline until an application ( Gasoline Dispensing Facility Application ) and a Compliance Plan ( EVR Compliance Plan ) has been submitted. A minimum civil penalty of at least $1,000 has been assessed and paid. Please note you will also incur weekly minimum civil penalty of $100 per week after April 1, 2009 until the project is complete. Or permanently discontinue the sale of gasoline. |

IMPORTANT INFORMATION FOR OWNERS OF PORTABLE EQUIPMENT
In order to legally operate within the Antelope Valley Air Quality Management District (AVAQMD), and/or the State of California, all portable engines greater than 50 brake horsepower must have an AVQMD Permit to Operate or a Portable Equipment Registration Program (PERP) certificate from the Californian Air Resources Board (CARB). Anyone operating this type of equipment without an AVAQMD permit or CARB registration is subject to penalties pursuant to Section 42402 of the California Health and Safety Code. A portable engine is an internal combustion engine designed to be carried or moved from one location to another. Examples of portable engines include, but are not limited to, electrical generators, tub grinders, woodchippers, compressors, well drillers, pumps, and cranes. Owners and operators of portable equipment are advised to check with the AVAQMD or CARB to determine program applicability.

Program Objectives
To improve the quality of the air in the Antelope Valley by funding local, cost-effective projects to upgrade heavy-duty diesel equipment using proven technologies and procedures that reduce oxides of nitrogen (NOx), particulate matter (PM) and reactive organic gases (ROG) from diesel-powered engines. Diesel exhaust is a serious public health risk, considered the number one airborne carcinogen in California, responsible for 70 percent of the cancer risk in CA from toxic air contaminants, and a major contributor to lung and heart problems. Funding is provided by California Air Resources Board’s (ARB) Carl Moyer Memorial Air Quality Standards Attainment Program and DMV Surcharge Fees.
