The Judicial Conference, at its September 19, 2006, session,
pursuant to sections 1913, 1914, 1926, 1930, and 1932 of Title 28,
United States Code, amended the
Electronic Public Access Fee Schedule
for the appellate, district, and bankruptcy courts, the United States
Court of Federal Claims, and the Judicial Panel on Multidistrict
Litigation. The amendment establishes a prohibition against the
unauthorized transfer of case information received under a fee
exemption granted by a court.
The following statement was added to the fee schedule:
"Any transfer of data obtained as the result of a fee exemption
is prohibited unless expressly authorized by the court." The
Conference also authorized the addition of a sentence to the
Policy Notes to the
EPA Fee Schedule,
stating the following:
"The prohibition on transfer of information received without
fee is not intended to bar a quote or reference to information
received as a result of a fee exemption in a scholarly or other
similar work." This amendment became effective on
September 20, 2006.
The fee schedule was updated again on September 18, 2007 to expand
the classes of persons eligible for exemption from the EPA fees.
