Federal Hatch Act Advisory:
Serving as a Delegate to a Party Convention


February 9, 1996



     This letter is in response to your request for an advisory opinion concerning the Hatch Act. We understand that you are employed with the Department of Housing and Urban Development and would like to serve as a delegate to the Democratic National Convention.

     The Hatch Act Reform Amendments of 1993 (5 U.S.C. ยงยง 7321-7326) generally permit most federal employees to actively participate in partisan political management and partisan political campaigns. Employees are permitted to serve as delegates to a state or national party convention. Accordingly, you would not violate the Hatch Act by serving as a delegate for President Clinton at the Democratic National Convention.
