Dear Chairmen Tauzin and Bilirakis:

We are pleased that the House Republican leadership has decided to place a priority on passage of legislation to provide a prescription drug benefit to our senior citizens. We too would like to see a drug benefit, and pledge to give it our full attention.

In light of the fact that some publications have reported that the House leadership may seek a vote prior to Memorial Day, we wish to draw your attention to several important procedural concerns that could strongly affect the quality of the legislation produced. We wish to avoid a repeat of last year’s bill, which was rushed through the Committee and had numerous problems. Specifically, we request the following:

Introduction of legislation: At this stage we have only seen generalized specifications of a bill from the Administration – sometimes changing – and no legislative language. In order to have meaningful legislative hearings, witnesses need to be able to discuss specific legislative provisions.

Hearings: Initial hearings on the general subject have been helpful, and we commend you. They do not, however replace legislative hearings on specific legislation. We urge comprehensive and balanced hearings when the legislation is introduced.

Markups: Legislation of this magnitude requires thoughtful consideration through the regular order of Subcommittee and Full Committee markups. Last year, Majority leadership floor deadlines precluded Subcommittee consideration altogether, and resulted in an all-night Full Committee markup session. That should not be necessary this year.

While we may or may not ultimately agree on this legislation, we believe that the regular order will benefit all Members of the Committee, and result in an improved bill. We stand willing to work with you toward that end.
