SUBCOMMITTEE ACTION

The Subcommittee on Health met in open markup session and took the following actions:

H.R. 1108, the “Family Smoking Prevention and Tobacco Control Act” was CONSIDERED.

The following amendments were offered:

An Amendment in the Nature of a Substitute offered by Mr. Pallone, #1, was pending when the Subcommittee adjourned.

A point of order was made by Mr. Deal that the Pallone Amendment in the Nature of a Substitute, #1, contained provisions that were not germane to the bill.  Mr. Pallone ruled against the Deal point of order.  Mr. Deal appealed the ruling of the Chair and Mr. Waxman moved that the Deal motion be laid upon the table.  The Waxman motion was adopted by a yea-nay vote: 16 – 12.

An amendment to the Pallone Amendment #1 offered by Mr. Deal, #1A, was withdrawn by unanimous consent.

An amendment to the Pallone Amendment #1 offered by Ms. Blackburn, #1B, was withdrawn by unanimous consent.

An amendment to the Pallone Amendment #1 offered by Mr. Pitts, #1C, was withdrawn by unanimous consent.

An amendment to the Pallone Amendment #1 offered by Mr. Pitts, #1D, was withdrawn by unanimous consent.

An amendment to the Pallone Amendment #1 offered by Mr. Pitts, #1E, was withdrawn without objection.

An amendment to the Pallone Amendment #1 offered by Mr. Barton, #1F, was withdrawn without prejudice to be re-offered at a later point.
