Benjamin Seibert has filed a lawsuit in Denver District Court asking for more than $100,000

KUSA – A Boulder man says Nancy Grace defamed him on national television when she showed a picture of his face and compared his actions to a "serial killer."

Benjamin Seibert has filed a lawsuit in Denver District Court asking for more than $100,000 stemming from a bizarre series of events earlier this year when a woman claimed a man had broken into her home and used her phone to take a "selfie" before leaving unseen.

The story, put out as Metro Denver Crime Stoppers tip, quickly became a national story. It was dubbed "the selfie stalker" case.

But soon after the story first aired, Seibert said he tried to notify Denver Police that he was the man in the picture, adding that he never broke into the home. As it turns out, the picture came from his Facebook page and was added to the woman's phone by unknown means.

Shortly after the "selfie stalker" story made headlines in Colorado, Nancy Grace showed the picture on her nationally televised show and stated, "this is a textbook serial killer's calling card."

The lawsuit claims Seibert has repeatedly tried to get Grace to issue a retraction and take the picture off of her Facebook and Twitter accounts.

9NEWS has reached out to a spokesperson for the Nancy Grace Show and has yet to hear back.
