Gas Well Ordinance Update

The proposed amendment to the Gas Well Drilling and Production Ordinance was approved by the City Council on July 21, 2009.

The City Council approved the amendments to the Gas Well Drilling and Production Ordinance on July 21, 2009, by Ordinance No. 1465.

The City Council amended Ordinance No. 1465, dated July 21, 2009, by adding a new section to include a Penalty section for the said Ordinance on August 4, 2009, by Ordinance No. 1467.

The City Council conducted a public hearing and amended Ordinance No. 1465, dated July 21, 2009 to provide correct references to applicable sections within this Ordinance, and to delete information that was inadvertantly retained from the City of Fort Worth Gas Well Ordinance on December 15, 2009, by Ordinance No. 1484. With this amendment, the Gas Well Permit Application Fee is now $10,000 for each well bore.

The Gas Well Planned Development (PD) application contains a checklist for all required documents for a Gas Well drilling and production request. All required signatures and documentation must be submitted for a complete application.

Purpose of Gas Well Ordinance Update:

The City Council determined that the current Keller Gas Well Ordinance needed an immediate update and the best method was to adopt the Fort Worth Gas Well Ordinance as a "placeholder" until a more thorough community review is undertaken. On April 21, 2009, the City Council appointed and charged the Gas Well Ordinance Review Committee to review the City of Fort Worth Gas Well Ordinance and make appropriate adaptations for the City of Keller. Below is the approving Resolution No. 2818 by City Council and their charge to the Gas Well Ordinance Review Committee.

Gas Well Ordinance Review Committee:

The Gas Well Ordinance Review Committee consisted of six committee members appointed by the City Council. City staff assisted the Committee for assembling and compiling all information and reports necessary for the Committee’s work to progress.

At the first Gas Well Ordinance Review Committee that was held on April 30, 2009, the committee appointed a Chairperson and Vice Chairperson. The committee met every Wednesday from April 30th to June 24th at 6:30 p.m. in the pre-council chambers located in Town Hall. All meetings were open work sessions, where the general public was invited to attend to listen and observe.

The Committee presented the amendments to the Gas Well Ordinance to the City Council on July 7, 2009 (first reading) and on July 21, 2009 (second reading) meetings. Both meetings were public hearing meetings. The City Council approved the proposed Gas Well Ordinance at both meetings.
