Tea Partying Steve Stockman Was the Only Texas Rep to Support an Important Pot-Law Amendment

U.S. Representative Steve Stockman is the Texas lawmaker who is probably least likely to whip out a joint at the party and share it with everyone. He likes families, straight people, guns and fertilized eggs that might one day become babies. He hates liberals.

Not as much as he hates the federal government, though, which is why he was the only Texas lawmaker to sign a new amendment that could make getting medical pot a little easier.

"This is a matter of following the Constitution," his spokesperson Donny Ferguson told Unfair Park in an email.

The House last week passed a historic amendment that would prevent the DEA from raiding medical marijuana dispensaries in states that allow them. The bipartisian amendment isn't law yet, but the 219-189 decision is an encouraging turn in places like California, which legalized medical weed in 1996 yet faced sweeping federal raids on dispensaries as recently as three years ago.

Of course, in Texas, that hasn't been a problem, since no weed of any kind is legal here anyway. But Stockman was one of 12 sponsors who signed the bipartisan amendment. In fact, he was the only Texas lawmaker to be one of the co-sponsors.

This from the same man who voted against the re-authorization of the Violence Against Women Act last year because of a provision that expanded provisions to transgendered people, or, as Stockman described them, "change-gender, or whatever." He added of the transgender protections: "This is helping the liberals, this is horrible. "

It appears then that decriminalizing marijuana is no longer regarded as a "helping the liberals" type of deal. Rick Perry even made some vague statements earlier this year that somewhat embraced marijuana decriminalization.

Stockman, though, frames this as a states' rights issue.

"Someone's personal opinions on marijuana use have no bearing on the fact the federal government cannot use armed agents to invalidate state laws. The Constitution is bigger than personal opinion."

Stockman compared Obamacare to sexually transmitted diseases.


Stockman has threatened to try and impeach President Obama if he used an executive order to set up new gun restrictions to prevent shooting massacres like the one at Sandy Hook Elementary School.


During his first stint in Congress, Stockman accused the federal government of "executing" members of the Branch Davidian cult after the Waco, Texas siege.

Listen to me on this, people -- you will never get pot decriminalization from Democrats.  


1) They are scared to death of being labeled as dopers or soft on crime.  They just can't risk it.  The only ones who can are the ones you know aren't soft on dopers or crime, meaning conservative Republicans.  It's the same way that Nixon was the only one who could go to China -- a Democrat was too scared of being called soft on Communism.  Nixon was immune to the charge.


2) There is too much government money in the War on (fun) Drugs.  As much as the dopers like to think that the Dems represent them, they really represent the unions and the lawyers.  The police union, the prison guard unions, the court system unions, the forced-treatment system unions, and the lawyers who get to make money bothprosecuting and defending people from The System.  There are way too many contributions coming to Dems from people who make their entire living putting poor people in jail for the crime of Having a Good Time.


You want drugs decriminalized?  Point out how much the drug war costs, how much of that goes to unions, and then vote Republican.

I would say that we will not get pot decriminalization from either entrenched group of politicians or either party.

Those who are profiting from the current and failed War on Drugs are active in and supporters of both the Republican and Democrat parties.

Neither Republicans or Democrats can claim they were behind the legalization of marijuana in Colorado or Washington, as both of those states had the legalization process begun by citizen initiatives.

To claim that Republicans should be voted for based on their support for legaization of marijuana is ludicrous.

@everlastingphelps I think that the majority of support in Congress came from Democrats, actually.  I'm a libertarian, and have no love for Democrats, but I think it's a little more nuanced than stated above.  It is refreshing, however, to see a Republican hold his nose and actually vote supporting the 10th amendment of the constitution, no matter how unseemly drug use may be to the party of family values.

@everlastingphelps The Republicans are the ones that started the War on Drugs and created the DEA (under Nixon), then heavily ramped up the War in the 80s under Reagan.  If you want to end the War on Drugs the last thing you should do is vote Republican, this stupid War wouldn't even exist if it wasn't for them.


Just look at the recent vote on getting the DEA to back down against legal weed states, which 170 Democrats and only 49 Republicans voted for.

Because it is safe for them to vote for when the amendment is proposed by a republican and there are enough GOP votes for it to pass.

They didn't vote for it in the three years where they had total control of government and could pass whatever they wanted on a party line vote (like they did obamacare).

It's not even decriminalized in Colorado, where in spite of the misleading media headlines, not a single FELONY marijuana statute has been repealed, not a single Misdemeanor marijuana statute has been repealed.


In fact, just a few months ago Colorado INCREASED the Felony level for some trivial marijuana quantity offenses to a CLASS 1 felony -- the same as Rape and Homicide, with an 8 - 32 year prison sentence attached.


The only thing Colorado did was COMMERCIALIZE marijuana sales -- with the State Government and Tax Pigs in total control -- and then naturally begin to attack and marginalize the rights of INDIVIDUAL Patients / Growers to create their own sustainable tax-free supplies.

@anonlibertarian @everlastingphelps The Dems held complete control over the Lege and the Executive for 3 years, and instead of ending the drug war, they gave us Obamacare.  (They actually expanded the drug war, including introducing expanding dispensary raids against Obama's campaign promises).


You aren't going to get drug war reform without the GOP leading it.  It isn't an accident that the amendment came from a California Republican.

A citizen in Colorado may legally cultivate 6 plants for their own use, and possess all of the product from those plants no matter the volume, and can lawfully travel outside their home with up to 1 ounce of marijuana.

that sure is "decriminalization" of use by the individual...the State didn't decriminalize the business of selling pot.

@weirdozmedia @everlastingphelps I didn't say that they are closer, I said that they are the only ones that can do it.  Dems can't and won't.  They had complete control over the entire federal government for three years, and they did nothing to end the drug war in that time.  Instead, they accelerated the militarization of the police, added police to agencies that don't even need them (why does the Dept of Agriculture have a SWAT team?) and shoved Obamcare down the country's throat.


Dems won't ever end the drug war.  If the 2008-2011 timeframe teaches anything, it is that they will expand it, because the police unions are a prime constituency for them, as is the entire penal system.  You aren't going to budge them on it.  You can budge conservatives like Stockman, on the fiscal and civil liberty side, and once they have the cover of "this is a GOP thing and we're just agreeing with them because we are wonderful bipartisans and it's about time they did something about the drug war" then they will vote for reforms.

I couldn't care less what party gets things done the way I want, I simply vote based on action.  And currently the Democrats are the only party taking what I consider proper actions - voting in support of State's rights and voting in support of Net Neutrality, both of which the Republicans have made clear they do not support in mass.  If they miraculously switch viewpoints with each other I'd be happy to vote red, but I don't see that happening anytime in the foreseeable future.

The only marijuana felonies are acts related to those who are engaging in the commerce outside of the regulations. This also applies to many other industries for products that have a controlled structure around them.

Why anyone would scream about the laws not allowing minors to freely possess and use marijuana is bizarre to say the least.

It's even decriminalized for minors under certain weight amounts as well.

We have as a society established that those under a established age, in this case 21 years, are not old enough to make the decision about ingesting alcohol and drugs. Yes, marijuana IS a drug. It is not a dangerous drug but nonetheless it IS a drug.

Should the laws allow for more liberal distribution? Glad to discuss that concept, but you are not capable of that apparently, all you do is scream inaccuracies and false claims such as "liar".

you should really not be so scorced earth on those who share your goals but don't have as extreme a position.

Under Colorado law, any adult who knowingly helps a person under age 18 break the law can be charged with this Class 4 Felony. This includes providing alcoholic beverages to minors. A Class 4 Felony conviction carries serious penalties including 2 to 6 years in prison, and fines ranging from $2,000 to $500,000.
