Dear Readers, I thought you might like to see the subpoena that David Poole, Sr. VP and General Council for Range Resources (NYSE:RRC) sent me. Since Calvin showed all the subpoenas David Poole sent him, I guess I can show mine.
My attorney filed a Motion to Quash this subpoena.
I’m learning a whole new vocabulary. A stay is not necessarily related to a vacation or something in a lady’s undergarment.
You should read both documents because your name might be in there. Really! They want a lot of stuff that is totally unrelated to this case. So, if you ever sent me an email saying Range Resources is a meanie because they ran over your dog, they want that email. Even if you emailed mad because you stepped in DoodyGate, they want that email. They want emails with the word Range in them so that could include free range chickens, the range of heat from my solar oven, or a place where you put a home, or something to do with math or…
I want to know what you think, Dear Readers. Is Range just trying to do discovery related to their counter suit against the Lipskys that I posted about HERE (excerpt below)?
In its counterclaim filed Thursday in state district court in Parker County, Fort Worth-based Range contends that it has spent more than $3 million to defend itself and suffered “significant harm to its well-deserved reputation as a high-quality driller and operator” in the Barnett Shale. LINK

As a bonus for reading through all that rubbage, here is my favorite email that my readers sent to Poole:
I have been very concerned and a critic of the rush to drill in PA from the beginning and I have noticed that the various companies have their own “personalities”.
If I were standing along the road with an anti fracking sign an Anadarko truck would be careful to avoid hitting me so not to cause a stir. The Chesapeake truck may or may not hit me but wouldn’t notice. Cabot’s truck is being driven by an incompetent so all bets are off. The Range Resource’s truck would drive off the road to hit me and then back up over me to make sure the job was done.
The nastiness and aggressiveness with which Range does its business has not only shown up in law suites in southwest PA but in the dealings with individual lease holders here in northeast PA. Folks in the country here do business with a handshake and they have grown contemptuous with the tactics of the gas industry in general and Range Resources in particular.
Most of the difficulties you are having, you deserve.

I would say there reputation is “well deserved”.
“there” should have been “their”.
WOW!!! Considering the “range” of documents they want, do they realize what a “range” of time you would have to go back and retrieve that “range” of documents from? It “ranges” from paper to all “ranges” of electronic data. You would have to ar”range” your entire house in order to gather that “range” of documents and that divers “range” of electronic communications. Do the realize that you probably don’t keep such a wide “range” of phone messages and the “range” of text messages is unreal. Let alone the “range” of Facebook posts over such a wide “range” of friends and groups. UGH! The “RANGE” of that request makes me tired.

So sorry. You must take that as evidence now. If I were you, I’d start printing out all this stuff and don’t waste paper, so use the backs of printer paper you already used. Give it to them in huge Rubbermaid boxes and wrinkle it up a bit, so it doesn’t move around so much in the boxes.
If ever there was a case of abuse of the law, this is it! They should be ashamed of themselves.

You may recall in earlier posts I said pretty much the same thing. Range Resources cannot use the courts to extract information from people that are not involved in the lawsuit. Given the terms of the subpoena and what they are after, supposedly, then by Range’s own definition, they should be sending out subpoenas to hundreds, if not thousands of people everywhere they operate.
Oh, and they forgot to mention ‘bar napkin’ in their definition of ‘all documents’.
If you do wind up having to produce all this stuff, you should include the video of David Poole testifying in his address the town council that ‘Frack fluid is safe’.
I can’t wait to see what those bullies at Range have to respond to the motion to quash.
Total intimidation plain and simple. The letter is spot on.
Range Resources has no one to blame for their image problem other than Range Resources.
Sharon, you know you and I are generally on the same side of things, even though we don’t see eye-to-eye on every topic and case. But reading this abusive and frivolous subpoena now makes me want to do everything in my power to help you fight these bullies and the corrupt judge who has let them run roughshod over people.
It is my opinion that this gas company should be renamed “FarRanging Gasholes Corporation”.
May be just trying to clear the image.

“Well-deserved” and “High quality” according to whom? Other than themselves, the three stooges at EID and, of course, the Texas Railroad Commission.
Including Josh Fox also smacks of a fishing expedition.

If RRC is so upset that someone sicked the EPA on them, why don’t they “grow a pair”, and subpoena the EPA directly. That way, they can avoid the appearance of intimidation of others, and REALLY find who tipped off the EPA. But, scaring others may be the root of all this.
Which will it be, Mr. Poole? I noticed there is a lot of what could be called “slander” about BP lately, but it also appears BP has had serious safety lapses, something the whole O&G Industry needs to be more self critical about.
