Steak sandwich shop can’t use Nemo’s name

The revived steak sandwich shop on South Bell Avenue cannot use the business name Captain Nemo’s for the foreseeable future.

Milton Fette and Randall Smith, who opened the sandwich shop in June, were ordered by a judge to stop using the Captain Nemo’s name at least until a trial is held in March 2015.

William Miller, who owns Captain Nemo’s in Irving, had sued the Denton business after it used the same sign and name as his shop. Miller’s father and Fette had been in business together at a Nemo’s in Denton in the 1980s and early 1990s, but the store was closed.

The business can no longer use the name on any materials, or the illustrated drawing that was on the Denton sign, which looked like the sign in Irving.
