Let's Try to Make Some Sense of the Jerry Jones Lawsuit Dismissal

Let's not worry about why. Let's just be grateful we may never have to see this damn photo again.
The statement lawyer Thomas Bowers issued Thursday morning after the dismissal of his client Jana Weckerly's sexual assault lawsuit against Cowboys owner Jerry Jones was precise: "Neither Jerry Jones nor the Cowboys organization has paid us any money."

If you're the suspicious sort, you might be wondering if that means NO ONE paid her ANYTHING. A signed jersey from Tony Romo, perhaps? A lifetime of free pizza from Papa John's, maybe? Something.

But let's assume for a second that Weckerly, in fact, did not receive any money when she agreed to the dismissal, which she and Bowers will not appeal. What would make the former stripper, seemingly out of the blue, drop a million-dollar lawsuit?

Chad Ruback, a prominent Dallas appellate attorney, has an educated guess.

"[Jones' lawyer] Levi McCathern filed a motion for sanctions a few days ago. In the motion for sanctions, he explained in great detail how Mr. Bowers knew, or should have known, that his claims were unsupported either by the law or by the facts," Ruback says.

Bowers knew Weckerly's case was frivolous, McCathern argued, so he and his client should have been required to pay Jones, the Cowboys and McCathern's legal fees.

"My guess is those attorney's fees are huge," Ruback says.

Arguments regarding the sanctions were set to be included in Thursday afternoon's hearing about the defendants' request that the case be dismissed because it was filed after the five-year deadline in the statute of limitations.

"My theory is that upon studying Mr. McCathern's motion and the law, Mr. Bowers became quite concerned that Judge [Dale] Tillery would be granting Mr. McCathern's motion and awarding sanctions," Ruback says. "I imagine that the hearing being scheduled for [Thursday afternoon] and the timing of the settlement are not coincidental."

Mutually agreeing to drop the case would have, potentially, saved Weckerly a ton of money. For McCathern and Jones, it removed all the risk of an unexpected ruling.

Perhaps Bowers' biggest tactical mistake was adding McCathern as a defendant in the suit. Judges, according to Ruback, are wary of attorneys who make their opposition one of the parties to a case, which may have increased the likelihood of a adverse ruling from Tillery.

We may never know whether it was the carrot or the stick that got Jerry out of this one, but at least we have an idea of what the stick might be.

We never heard anything about a second woman who was present. What was her testimony or statement?

Semantics.  Jerry Jones' son could have paid her off, and that statement would still be true.

Myrna wonders just how many Weckerlys are out there, wanting to get out of the trade with a big judgment, gathering evidence against the old pig.

Weckerly is judgment proof.  Weckerly is a former stripper.  Weckerly would have to be cashed out regardless of her lawyer's misstep or fate.  Weckerly would not have agreed in mediation unless Jones had a hammer.

like paying one of her former stripper friends to go public.  Prostitution, maybe.  Or a former John.

Strippers are tough.  Weckerly would expect her lawyer to fall on his sword after investing this much time in milking Jones.

Sanctions my ass.

@holmantx The sanctions wouldn't be just against her.  They would be joint and several with the law firm.  She might be judgment proof but her lawyers aren't.

So she milks Jones for a period of YEARS, he stops paying, she files suit before the statute of limitations runs out, takes him public, then suddenly drops it because her lawyer might get sanctioned?  She's in the friggin' RED ZONE man!  First and goal.

Something happened but it probably was a result of a pack of private investigators.

How is Stephen progressing in his OJT, does anybody know outside the Jerry-centric spotlight? Al Davis did a terrible job of preparing his son for managing ownership of the Raiders, and apparently did a terrible job of simply rearing a son, too. OTOH, Pittsburgh's Rooney family have done a great job for almost a century now of preserving and growing that franchise.

@holmantx She didn't get in before the SoL.  It had tolled.  They tried a BS argument that since Jones sometimes leaves the state, the were entitled to some kind of offset, but I can't see the judge giving them that.

@holmantx @everlastingphelps She didn't drop it.  The court threw it out for being frivolous, that's what TRCP 91a is.  The judge probably based that mainly on teh statute of limitations, but I'm sure the plaintiff being batshit crazy was part of it too.  What she did was agree not to appeal that decision.


That is where the negotiating took place.  "Look, you've already lost.  If you appeal this, we're going to go to the judge, who obviously isn't digging your shenanigans, and demand sanctions on top of the fees that 91a entitle us to, and he's probably going to give them to us.  Just walk away, it can only get worse for you."

@holmantx @everlastingphelps The lawyer is the gatekeeper.  He has an ethical obligation to make sure that her claims are actual live claims.


Rule 11 requires the lawyer to certify that:


(1) it is not being presented for any improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation;

(2) the claims, defenses, and other legal contentions are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law;


That burden is on the lawyer.  From the Advisory Committee (the ones who essentially make the rules):


If the duty imposed by the rule is violated, the court should have the discretion to impose sanctions on either the attorney, the party the signing attorney represents, or both, or on an unrepresented party who signed the pleading, and the new rule so provides. Although Rule 11 has been silent on the point, courts have claimed the power to impose sanctions on an attorney personally, either by imposing costs or employing the contempt technique. See 5 Wright & Miller, Federal Practice and Procedure: Civil §1334 (1969); 2A Moore, Federal Practice  11.02, at 2104 n.8. This power has been used infrequently. The amended rule should eliminate any doubt as to the propriety of assessing sanctions against the attorney.

@everlastingphelps @holmantx It's not like JJ was hiding when he left the state.  They knew where he was.  That exception is for someone who goes on the run intentionally hiding is what my lawyer buddy told me
