CONROE (AP) - A hearing is set on whether to remove the judge in the felony child abuse case against Minnesota Vikings star Adrian Peterson.
The recusal hearing for Montgomery County state District Judge Kelly Case is scheduled for Wednesday in Conroe. Retired Tarrant County state District Judge Jeff Walker will preside.
Peterson is charged with injury to a child for using a wooden switch to discipline his 4-year-old son.
Prosecutors want to replace Case, accusing him of being biased against them. Peterson’s attorney Rusty Hardin has argued the bias claims are based on conjecture.
A motion to revoke Peterson’s bond for alleged marijuana use is on hold until the issue with Case is settled.
Case set a tentative trial date for Dec. 1. Peterson is on paid leave from the Vikings.
